The Miracle Rules

Purchaser, and anyone to whom a purchaser legally transfers a ball drop or raffle ticket, must be 21 years or older at time of purchase. Purchaser may enter more than once and need not be a resident of the state of Arizona. Only one (1) individual may be identified as an entry owner. Entries may be purchased via the Internet (www.SedonaMiracle.org ) or Call Center (1-877-282-5057). For Internet purchasers, ball and ticket numbers and confirmation will be immediately forwarded to the e-mail provided. Purchasers using the Call Center will be forwarded confirmation by provided e-mail or by mail within 10 business days of purchase. By entering the Sedona Miracle 2007 (the "Miracle") events, the purchaser acknowledges that he or she is aware of, and agrees to abide by, The Miracle's Rules.

The following individuals and their respective affiliates, subsidiaries, parent, and related companies and agencies are not eligible to win in the various Sedona Miracle 2007 events of chance:

a. Board members and executive management staff of the charity beneficiaries of these events (Boys & Girls Clubs of Northern Arizona, Sedona Community Foundation, Verde Valley Sanctuary.)

b. Any persons employed by or associated with the ball drop helicopter contractor(s).

The above list of exclusions (items a and b) also applies to immediate family members residing in the same household, and the immediate families (spouses, parents and children and their respective spouses) of anyone so associated are not eligible to win the prize(s) described herein; however, said persons may purchase golf balls and give them to individuals (other than those defined above), and those individuals and charity beneficiaries will be eligible to win the prize(s) described herein provided they are 21 years of age or older”.

A maximum of 40,000 golf balls will be sold for the price of $25 each USD. All golf ball purchases are final and non-refundable. The specific golf ball numbers purchased will be generated at the time of sale and forwarded via email and USPO mail to the purchaser-provided email address. All purchased golf balls will be individually and uniquely numbered and randomly placed into eight separate bins. On Saturday afternoon, September 15, 2007 the contents of the bins will be randomly divided equally and two (2) separate helicopter drops will be made of up to 20,000 golf balls per drop. At the Oakcreek Country Club in the Village of Oak Creek, Arizona four (4) pre-selected, specially made holes (to be used for both drops) will be prepared and linked with one (1) Grand and three (3) Premier Prizes for each ball drop. The registered golf ball owner whose (numbered) ball is found at the bottom of the specially made holes will receive that hole’s respective prize. If more than one golf ball lands in a hole, those golf balls will be recorded along with the second, third and fourth golf balls which are closest to the bottom of the hole and held in reserve until the first place prize winner for that hole claims his/her prize. If no golf ball goes into a hole, then the golf ball landing closest to the hole will win that prize. The golf ball closest to the hole will be determined by measuring the distance from the center of the hole to the golf ball by pre-selected judge(s). Furthermore, three (3) additional golf balls will be measured from the center of the hole in receding order in the event the first place prize winner does not claim his/her prize. Decisions by the pre-selected judge(s) on all aspects of this event will be final and binding.

If some unforeseen event occurs that prevents the helicopter service from being able to conduct the ball drop event as outlined above, then the winner of the prizes will be determined by an alternate process as follows:


a.  A random number generator program will be created.

b.  The random number generator program will be run eight (8) times to determine the winner of each premier prize. For each of the eight (8) prizes, an additional three (3) numbers that will be generated to determine, in the order of the number generated, a substitute prize winner in the event the original prize winner cannot be located after a period of 30 days as provided below.

c.  The random number generator program will be created by one party and verified by another party.

d.  The determination of each prize winner will be audited by various representative parties including a Notary Public who will attest to the winning results.

e.  The results will be sealed and kept by an independent third party. On September 15, 2007, the independent third party selected to hold the results described in (e) immediately above, will be in attendance and provide the results of the alternative process to determine a winner if the helicopter service is unable to conduct the ball drop.

 

A maximum of 10,000 raffle tickets will be sold for each raffle item unless otherwise noted. All raffle ticket purchases are final and non-refundable. Specific ticket numbers purchased will be forwarded via email to the purchaser-provided email address or by USPO mail if no email is given. Drawing dates for raffle items will be posted on the web site for each specific raffle; all time references are Arizona local time. Entry purchasers may win more than one raffle/ prize. There is no possibility of a tie. Each raffle will be held using its own set of specially printed tickets representing precisely the numbered tickets sold for that raffle. The winner of a raffle will be determined by direct drawing of the winning ticket from the group of tickets sold. Furthermore, three (3) additional 1st, 2nd, 3rd runner-up tickets will also be drawn and held in reserve in the event the first place prize winner does not claim his/her prize. All raffle drawings will be under the supervision of a Certified Public Accountant and the pre-selected judge(s) decisions by the pre-selected judge(s) on all aspects of this event will be final and binding.

Waiver / Limitations of Liability

Entry purchasers, by participating (and winners, by accepting a prize) release officers, directors, Board members, executive management staff, employees, agents and representatives, advertising agencies and promotional partners of Seven Canyons, Boys & Girls Clubs of Northern Arizona, Sedona Community Foundation and Verde Valley Sanctuary and any other non-profits benefiting from the ticket sales and the ball drop helicopter contractor and affiliates, from any and all liability, loss, harm, injury, damage, cost and expense whatsoever arising directly or indirectly with respect to participation in the promotion, possession, use and distribution of the prize(s) awarded.

By purchasing tickets for the events, each winner consents, without limitation or additional compensation, to the use of his/her name, voice and/or photograph / video representation for advertising and/or trade purposes, except where prohibited by law.

Odds of winning depend on the number of valid entries received by the deadline set forth for each event.

Internet

The Sedona Miracle 2007 will pursue any and all available legal remedies against any individual(s) damaging or attempting to damage any Sedona Miracle web site or attempting to undermine the lawful operation of the event or raffles.

Taxes and IRS Rules

All winners shall be responsible for any and all federal, state and local income or excise taxes, fees, assessments and like charges associated with the prizes. All vehicle winners shall be responsible for any and all state or local license, title and registration fees associated therewith. (also see: Special Note)

Prizes

No prizes may be exchanged for cash value. With proper transfer or sales documents bearing notarized signatures, as required by the Sedona Miracle 2007 event, a prize may be transferred, sold or donated to any of the nonprofit charities participating in the Sedona Miracle 2007. The beneficiaries of the ball drop (Boys & Girls Clubs of Northern Arizona, Sedona Community Foundation and Verde Valley Sanctuary and other non-profits benefiting from the sale of event balls /tickets) are not responsible for a winner’s ability to claim or use the prize in accordance with the guidelines set forth herein.

Notification of Winners

The winners of the Sedona Miracle 2007 ball drop prizes will be announced at the site and by telephone, email and/or mail. Winners need not be present to win. Winners will be posted on www.SedonaMiracle.org within the week following September 15, 2007.

All winners will be notified via courier, mail or by e-mail where available, by the Boys and Girls Clubs of Northern Arizona. All prizes must be collected in Sedona or shipped at winner’s expense, to the address provided by the winner. All winners have fourteen (14) calendar days from notification of winning to inform the Boys and Girls Clubs of Northern Arizona of the winner’s choice of delivery of the item.

Winners are required to claim prizes within thirty (30) calendar days. Three (3) business days after the completion of the ball drop or a raffle, entry purchasers can access www.SedonaMiracle.org to check prize-winning status. Also at that time, a complete list with prize winners’ names and locations by city or town, and state, will be available on the web site. A printed version of the prize winners list will be available within 30 days of each event by contacting the Boys and Girls Clubs of Northern Arizona in writing at its address below.

Three (3) attempts will be made to contact the winner at the address provided. If selected winner is unable to be contacted or located or fails to claim the prize within thirty (30) days after notification, the prize will be forfeited and awarded to the next winner in line as provided under either the Rules above or the second place winner in any raffle etc. If no winner comes forth after attempting to contact four separate, sequential winners, then the prize will be forfeited to Sedona Miracle 2007 for the benefit of all local non-profits.

All entries become the property of the Sedona Miracle 2007 and will not be returned.

Verification of eligibility and identity will be required before releasing any prize.

At the time of this writing, federal law requires that corresponding tax withholding on prize values of $5,000 or greater must be collected from winners upon award and distribution. Federal and state withholding laws are subject to change without notice. The withholding laws in effect at the time prizes are claimed will be followed.

The IRS has taken the position that amounts paid for chances to participate in raffles, lotteries or similar programs are not gifts and, therefore, the price of the entry does not qualify as a deductible charitable contribution, though it may be deductible under other sections of the Internal Revenue Code.
